Secretary Of State Decision

The Secretary of State has informed Cornwall Council of his decision not to call in ING's supermarket planning application for South Quay, Hayle. Consequently the decision to grant planning permission remains with Cornwall Council.

The Council's Strategic Planning Committee previously resolved at its meeting of 6th October 2011 that the Committee was minded to approve application number PA10/08142 subject to the applicant entering into a Section 106 obligation and the use of conditions to control the development.

Negotiations with the applicant regarding the Section 106 and conditions are ongoing and the Council hopes to be in a position to issue a decision notice shortly.

Decision

The Strategic Planning Committee met on the 6th October 2011 and resolved to approve the ING application for South Quay subject to referral to the Secretary of State and the completion of legal agreements. It refused permission for both the Morrisons and Asda applications.

Referring the ING application allows the Secretary of State to decide whether or not to call-in the application due to an ongoing English Heritage objection or on the grounds of retail matters. Should a call-in occur then there will be a public enquiry. In the event that there is no call-in then it will be determined by the Council on completion of legal agreements which will involve the Hayle community.

The Hayle Rugby Football Club application to relocate was also approved by the Committee.

Following the previous presentations by the applicants for each scheme on the 1 September reported below members of the Strategic Planning Committee met with officers to receive a technical briefing on each scheme as well as receiving briefings on procedural and legal matters. All three supermarket applicants presented the members of the Strategic Planning Committee with up to date information on their development proposals ahead of the formal Committee Meeting on the 6th October.

Revised documents submitted 29 July 2011

Both Morrisons and ING have submitted further information in support of their planning applications.

Given the nature of this information the Council is writing to all those who have previously responded to the applications advising them of the new information and a press notice will feature in the 4th August edition of the Cornishman newspaper.

Any comments you wish to make on these applications should relate solely to the new or revised information submitted. To assist, these documents have been prefixed on our web site pages with the word amended.

Outcome of Strategic Planning Committee meeting 2nd June 2011

In relation to all three applications it was considered that currently there was insufficient information available to enable Members to make a decision at the present time.

The committee resolved that a future report be prepared for the 22nd September 2011 Strategic Planning Committee meeting and that dates for presentations to Members be arranged for all of the applications, at least a week prior to this date.
