- Stephen CWLL REASONS: 1 A significant portion of the site lies within Flood Zone 3a. Advice in the NPPF is clear in that development should be steered towards sites with a lower risk of flooding. While part of the site lays within Flood Zone 1 the scheme as a whole requires development within the flood plain. It is considered that the proposal would fail a sequential test and that there is not an overriding need for the development. It is therefore contrary to policies GD-4 and CS-4 of the Penwith Local Plan 2004 and advice in National Planning Policy Framework paras 17, 99, 100 and 103, and the Technical Guidance to the National Planning Policy Framework paras 2, 3, 5 and 6. 2 It is considered that insufficient and inadequate information has been submitted to properly allow the impact of the development on the local highway network and in particular Loggans Road to be assessed. It has not been shown that there would not be unacceptable congestion with a consequent adverse impact on local residential roads and increased use of unsuitable country lanes. Also the proposed access would result in an unacceptable conflict with the recent highway safety improvement scheme. It would therefore be contrary to policy GD-5 of the Penwith Local Plan (2004) and advice in the National Planning Policy Framework, paras 17, 32 and 35. 3 It is considered that insufficient and inadequate information has been submitted to properly allow the impact of the development on the Loggans Moor SSSI and principal species for biodiversity to be properly assessed. In particular the impact on the hydrological cycle is not properly understood. The application also fails to properly consider the opportunities to enhance biodiversity at the site. It is therefore contrary to policies CC-7, CC-9 and CC-10 of the Penwith Local Plan (2004), advice in paragraphs 17, 109 and 118 of the National Planning Policy Framework, and the requirements of the Conservation of Habitats and Species Regulations 2010. 4 In the absence of a signed planning obligation relating to the provision of a contribution to highway improvements which is an obligation required to make the planning application acceptable the proposal is contrary to advice in the National Planning Policy Framework 2012 paragraphs 17, 203 and 204.

- Charlie Jenkin M&S, Next and boots are also built on the flood plain and if I remember that part of the causeway had problems when built.
- Paul Birch Funding was put in place for Foundry Barn, why isn't funding applied for to demolish the old mill and use the recycled materials to build this development on the site of the mill. Two fold then it isn't too close to the A30 and it will have better acc...See More
- Andrew Turner The only suitable site for future retail development in that area of Hayle is the present Rugby club site.
- Paul Birch what retail development is that then. this is a business development with workshops not retail.
- Graham Coad Charlie Jenkin, M&S, Next Boots, and COSTA were NOT built on a flood plain, only the very lowest corner of the site is flood plain.

- Paul Birch Yes the Rugby Club site Andrew Turner but the application that this relates to is on Loggans Moor behind Lidls.
- Paul Birch Been refused for business units though which is the point i am raising, you are talking about retail at the Rugby Club. In the words of the song 'Let it Go'. At the moment no one has the money available to develop the rugby club site. Walkers Certainly cant fulfill their side of things
- Andrew Turner If planning gets approved the money will arrive..But probably more detail will be asked for before final approval is given.

heard that Mr. Walker may be back as early as March this year with his
deferred planning application for the development on the Rugby Ground
(and a new Rugby Club at Carwin rise.)
If it DOES get planning permission I suspect that "the money" will follow the planning permission.
